Gov. Abbott announced last week that he was shutting bars and nightclubs down again due to rising cases of COVID-19.

“At this time, it is clear that the rise in cases is largely driven by certain types of activities, including Texans congregating in bars. The actions in this executive order are essential to our mission to swiftly contain this virus and protect public health," Governor Abbott offered.

Well, the Texas Bar and Nightclub Alliance has retained council and plan to file a lawsuit against the mandate. The TBNA are encouraging bar and nightclub owners to join the lawsuit and protest by remaining open stating on their Facebook page, "In light of Greg Abbott’s irresponsible and shameful actions this morning that shutter the businesses that provide a livelihood for your families and employees, we support our members in the constitutional right to protest by keeping your businesses open. Please understand that you may receive a visit by your local police, health department and/or TABC. The result of their visit can be a $1000 per day fine, a 30 day suspension of your license if you refuse to shut your business." 

Further adding, "TBNA has engaged with attorney Brent Webster and his firm, Edwards Sutarwalla, PLLC for guidance and representation through this difficult time. Any business or business owner that chooses to exercise their right to protest and is ticketed, fined, suspended licensed and/or criminally charged, we have counsel standing by to aid if you would like their assistance."

TBNA offered that although they will not likely be able to cover all bar and nightclub owner fees, they wanted to reassure members of the TBNA that, "Board members have been generous in retaining legal counsel on behalf of all 51% licenses across the state so that we can file suit this week against the State in both state court and federal court seeking a TRO ( Temporary Restraining Order) to end the Governor’s overreach. Additionally they are asking bar and nightclub owners to join the TBNA organization here.
