Buc-ee’s Copyright Infringement Takes Down Missouri Store ‘Barc-ee’s’
Earlier this year, Buc'ee's filed a trademark infringement on Missouri based gas station, Barc-ee's. It looks like it worked because the Missouri store closed down on April 17th of this year. The casual person could of easily recognized the similarities between both stores. The suit also alleged that Barc-ee's acknowledged that Buc-ee's was the inspiration for the concept as reported by Fox 4 News.
These were some of the of the similarities, Barc-ee's has a dog park, coffee and food shops. It also has a Western-theme as well. It is located in Southwest Missouri. Buc-ee's also alleged the mascots are very similar. Even down to the lettering of the logo and even the red tongue of the mascot. You be the judge.
TikToker theipprofessor put his comedic spin on the whole situation.
@theipprofessor Rest stop juggernaut Buc-ee’s is going after… a small dog cafe/dog park in Springfield, MO?! You read that right! In an attempt to protect its brand as it continues to expand nationwide, Buc-ee’s has pursued a trademark infringement claim against Barc-ee’s, alleging trademark infringement and dilution among other things. As is the case with any trademark infringement matter, the question really is whether or not there is valid evidence of consumer confusion. Would someone see Barc-ee’s and be led to believe that it is affiliated with Buc-ee’s? Is Buc-ee’s looking to even expand into the pet industry? All these questions and more are likely to come out as this case unfolds, but I see this drawing out potentially into a lengthy legal battle. #TheIPProfessor #IntellectualProperty #Trademark #TrademarkLaw #TrademarkInfringement #Bucees #Barcees #LawSchool #LawStudent #LawProfessor ♬ original sound - ITYSL
